I have $6k in taxes b/c my employer didnt file FIT or SIT. Our agreement was NET salary. There defense is check stubs

Agreement was NET $3800 (which I received) however they did not report FIT or SITs and they are saying even though the agreement is NEt that they are not obligated to pay it and that it is an ‘option’. Also, in there defense they are saying that they listed in the pay stubs, however our original agreement was NET $3800/mo.
