We have discovered our neighbor has a deck that extends 5 ft. onto our property. What should we do?

Both homes were purchased with deck in place, unknown if it was permitted. There was no formal survey prior to purchase and we relied on title documents. We would like to add a fence on the property line, can we demand the 5ft section be removed?
