CONTRACT ASSIGNMENT
In search of egg donor and gestational carrier. We are a married couple who can’t have children on our own and need help. We are
looking for a healthy woman between the ages of 21 and 30 to donate her eggs and a healthy woman between the ages of 21 and 35 to
carry fertilized embryos and deliver a baby for us. We will pay for services at a reasonable and ethical rate. Please contact us at

Karma sent an email to that address indicating that she was interested in learning more about being a gestational carrier and
negotiating payment for such.
Assignment
You are assigned to represent Raven and Brady, Your job will be to discuss the BIRTH, you will discuss the expectation the birth be at
a hospital, natural with medications prescribed by doctors. C Section if necessary. Relinquishment of Acceptance of Rights and how the
birth certificate will look. You even have to discuss who is allowed in the hospital room, who is allowed to see the baby, interact
with baby, how long ETC.
At this stage, you know that the laws of the State of Maryland will govern, all parties desire an arbitration provision, the contract
can be signed in counter-parts and that if one provision is declared invalid, the rest of the contract should survive.
Guide Lines

Medical – checkup, blood test

Shady Grove Fertility Center will conduct screening
Criminal Background Check
Couple and GC get results of Donor’s screening
Will provide copies of medical insurance policies to couple
Carrier

Shady Grove Fertility Center will conduct screening
Criminal Background Check
Already given birth to at least 1 healthy, full-term child
Uterine Evaluation
Normal & up-to-date PAP smear
Undergo Mock Cycle – injection of hormones and evaluation of uterus
Will provide copies of medical insurance policies to couple
o Spouse of Carrier (Bob)
o Partner of Gestational Carrier – infectious disease screening and psych screening at Fertility Center
o Father – Brady
Psychological Screening –
Genetic Questionnaire – related to fertility, family mental and physical illness
Shady Grove Fertility Center will conduct screening
Criminal Background Check
Donor and GC get results of Father’s medical screening
o Couple – Criminal Background Check
Father/Couple Criminal Background and criminal history disclosed to donor and carrier
• Medical Process
o Donor
Process occurring June, July & August
Stimulation – injections of fertility medications over 7-10 days under supervision of fertility clinic doctor
Ultrasounds, blood test and medical evaluations during the process
Retrieval Process- HCG injection, 36 hours after HCG, retrieval via ultrasound guided needle.
Donor follow medical advice during procedures.
Donor will be responsible for her own travel to and from medical appointments
Donor allows eggs retrieved to be fertilized with Brady’s sperm for transfer to GC
Donor will repeat cycle a second time if first cycle does not result in 5 viable eggs
Fertilized embryos will be used to achieve a single pregnancy and birth. After delivery of a child, any remaining fertilized embryos
will be destroyed.
o GC
IVF Cycle to prepare uterus and sync with donor. Hormone injections. This will occur in June, July and/or August.
Abstain from sexual intercourse during cycle in accordance with doctor’s advice
Fertilized embryos transferred to uterus of GC
Pregnancy test 2 weeks after transfer to confirm pregnancy
Gestation of embryos
• Follow doctor’s orders
• Bloodwork/ultrasounds every 4 weeks or more if required by doctor
• GC will make good faith effort to maintain a healthy lifestyle
• Follow OBGYN’s orders with regard to prenatal care
Doctor will be GC’s existing OBGYN – Dr. Gary Bowen
Birth – at hospital unless emergency prevents such
• Natural – with medications as prescribed by doctors
• C-Section – if medically necessary for health of baby or GC, GC gets to make decision based upon medical advice
• Pay/Partial
o Escrow – paid up front by the couple medical and donor and carrier fees
o Medical Costs
All medical costs of donor to go through process until doctor discharges

o Fees
Donor
• $8500 in escrow
o Payment of $500 after each screening process and medical appointment
o Remainder in escrow paid upon completion of retrieval
GC – $80,000
• $12,000 upon signing of contract
• $1500 – screening
• $8000 – additional screenings recommended by GC OBGYN
o Chorionic vilus sampling
o Amniocentisis
o Alpha –Fetoprotein
o Corocentesis/PercutaneosUmbilication
o Includes costs of the tests too
• $500 – maternity clothes (before 3 months into pregnancy)
• $250/month for food and necessities. $100 additional per month for each child if multiples
• $3500 for counselor to support GC during pregnancy
• Couple pays for counselor fees
• $12,000 after delivery of child, even if still born, but not for miscarriage that does not result in labor and delivery
o $5000 for delivery of each additional child if multiple pregnancy
• Travel to doctor & lost pay for doctors’ appointments and delivery
• Gestation up to $36,000 prorated and payable for each month of pregnancy
o If miscarriage, then payments cease
o Payments stop at birth
o Complications – see health insurance below
• Multiple Pregnancies
o Selective reduction only if health of GC is at issue and doctor advises
• Relinquishment and Acceptance of Rights
o GC relinquishing any and all parental and/or property rights
o Couple assumes any and all parental and/or property rights, even if child is unhealthy or disabled.
o Couple wants to be able to have contact Donor in future if health of baby is at issue and it is hereditary in nature.
o Donor relinquishing any and all parental and/or property rights
o Couple assumes any and all parental and/or property rights, even if child is unhealthy or disabled.
o Intended mother (Raven) and intend/genetic father (Brady) will have name put on certificate.
o Couple will establish legal guardian for children born as a result of a contract in case of event that both husband and wife die.
• Liability
o What happens if donor or carrier doesn’t follow procedures and child is not born or born with defect?
o If GC’s actions or inactions cause injury to embryo, fetus, child, then it is a breach of contract.
o Breach if Couple doesn’t take child
o Breach if couple doesn’t pay
o Breach if GC or donor lies in screening or does not follow doctors’ advice or terms of contract.
• Insurance
o Life Insurance – Couple will buy life insurances for death of GC (for duration of pregnancy) & Donor ( 3 months) a result of
processes in contract
o Donor warrants she has health insurance to cover medical expenses associated with complications
o GC warrants warrants she has health insurance to cover medical expenses associated with complications
o Couple will pay medical expenses for treating complications that are not covered by insurance
• Other items
Couple can be present during labor and delivery
Raven is first to hold baby and then GC can hold baby after for a brief period
• Contact with child
o Donor and GC will not have contact with child born
o Donor and GC identities will not be released to child until child turns 18
